I am uneasy about the proposals because: 1. There is a danger that these traffic offences will be seen as ‘downgraded’ if they are no longer criminal offences. Some drivers may be less concerned about breaking the rules if the do not risk a criminal conviction. 2. The Council will be obtaining increased power over people. 3. The Council will have considerable financial incentive to adopt a simple, automatic system that imposes penalties with minimum admin. You do not say how the Police currently identify offenders and what their policy is regarding prosecution. For the Council ANPR will no doubt be the enforcement method of choice. You claim that ANPR will only be introduced where ‘all other methods of deterrent’ have been tried. This is a very high bar. However, we are not told what those other methods are, nor how their success or failure is quantified, nor why ANPR will succeed where they have failed. These are complex junctions and an automatic penalty system will make no allowance for mitigating circumstances. Box junctions are especially tricky – a driver waiting legitimately in a box junction to turn right can very easily find their exit suddenly blocked by another vehicle cutting in front of them. Will the ANPR system simply generate an automatic penalty notice, or will there be someone making a judgement on the circumstances? 3. Will statistics be published regarding the success or otherwise of the new system (in terms of the listed objectives) for each location? Will additional locations be added before the outcomes from the first sites have been measured? What will you do if the new system is no more of a deterrent than the previous ones?
